Terms of Sale

These terms apply to artworks sold directly from the studio through this website. Please read them before sending an inquiry. Sending one is not itself an order, and nothing is binding until both sides have confirmed in writing.

The studio trades as an enskild näringsverksamhet, a Swedish sole trader. For that business form the organisationsnummer is the proprietor's own personal identity number, so the last four digits are withheld here to guard against identity fraud. The full number, and the studio's Swedish VAT registration number, are stated on every quote and invoice and are given in full on request.

2. How a sale is made

This website is a catalogue, not a checkout. No price shown here is a binding offer, and no order is placed by using the site.

You send an inquiry about a work.
The studio replies personally, confirming that the work is still available and setting out the final price, delivery cost and timing.
If you accept that offer in writing, a contract is formed.
An invoice follows, and the work is dispatched once payment has cleared.

Every work on this site is an original or a numbered edition, so each is a single item. If two people inquire about the same work, the first written acceptance takes it.

3. Prices

Prices are shown in euros (EUR). Works marked On Request are priced individually on inquiry.

The studio is registered for VAT in Sweden. Prices shown include Swedish VAT, so nothing further is added for buyers in Sweden and the amount you are quoted is the amount you pay for the work itself. The VAT amount and the studio's VAT registration number are itemised on every invoice.

Prices exclude delivery. The delivery cost is quoted separately for each work and added to the invoice, unless the studio's written offer says otherwise.

For deliveries outside the EU the sale is normally made free of Swedish VAT. Any import duty, customs charge, handling fee or local sales tax in the destination country is the buyer's responsibility. These are levied by the carrier or the customs authority on arrival, are not included in the price, and are not refunded by the studio if you later cancel.

4. Payment

Payment is by bank transfer against invoice, in the currency stated on the invoice. Bank details appear on the invoice itself. The studio will never send you new or changed bank details in a separate email, so treat any such message as fraudulent and call to verify.

Ownership of the work passes to you only when payment has been received in full.

5. Delivery

The studio ships worldwide.

Delivery cost is quoted per work, since it depends on size, weight and destination. A large canvas or a bronze has to be crated rather than boxed. The quoted cost is paid by the buyer and added to the invoice, unless the written offer says otherwise.

Works are dispatched as soon as possible once payment has cleared, normally within a few working days. The studio confirms the expected dispatch date in writing when it accepts your order. In any event delivery takes place no later than 30 days after the contract is formed, unless a longer period is agreed between us. Transit times after dispatch are given in good faith but cannot be guaranteed, as they depend on the carrier and on customs.

All works are shipped insured for their full value. The risk of loss or damage passes to you when the work is delivered to you, not when it is handed to the carrier.

Inspect the packaging on arrival. If there is visible damage, note it with the carrier at the moment of delivery and photograph it before unpacking, then contact the studio within 7 days.

6. Your right to cancel

If you are a consumer in the EU, you have the right to withdraw from this purchase within 14 days without giving any reason. The period ends 14 days after the day on which you, or a third party you name, takes physical possession of the work.

To exercise it, tell the studio in a clear statement before the 14 days are up. An email to ba.adamsson@gmail.com is enough. You may use the model withdrawal form in the Swedish Consumer Agency's standard wording, but you are not obliged to.

If you withdraw, all payments received from you, including the standard delivery cost, are refunded without undue delay and no later than 14 days after the returned work is received back, or after you show proof of return, whichever is earlier. The refund goes back by the same means you paid, at no charge to you.

Return costs and condition. You bear the direct cost of returning the work, and it must be returned in its original condition and, where possible, its original crate or packaging. Because these are original artworks, a return must be packed to the same standard it arrived in; the studio will advise on this on request. You are liable for any reduction in the work's value resulting from handling beyond what is necessary to establish its nature and condition.

Commissions and custom work are excluded. The right of cancellation does not apply to a work made to your specification or clearly personalised for you, such as a commissioned portrait or a piece altered at your request. This exclusion is provided for in the Swedish Distance Contracts Act (distansavtalslagen) and in Article 16(c) of the EU Consumer Rights Directive, because such a work cannot be offered to anyone else.

Where a commission is involved the studio will say so in writing in its offer, before you commit, so you always know which terms apply before any money changes hands.

7. Faults and complaints

As a consumer you have a three-year right of complaint under the Swedish Consumer Sales Act (konsumentköplagen) for a fault present at the time of delivery. This is in addition to, and not replaced by, the 14-day right of withdrawal above. Report a fault within a reasonable time of discovering it, which is always at least two months.

Note that visible brushwork, canvas texture, natural variation in bronze patina, and the deckled edges of hand-pulled prints are characteristics of original artwork, not faults.

8. Authenticity

Every work sold through this site is guaranteed to be an original work by Bo Åke Adamsson, or an authorised print from a limited edition, and comes with a signed certificate of authenticity stating its title, medium, dimensions, year and, for editions, the edition number and size.

9. Colour and dimensions

Dimensions are given in centimetres, height × width, and for sculpture height × width × depth. They describe the artwork itself and do not include a frame or base unless stated.

Photographs are reproduced as accurately as possible, but colour on a screen depends on your own display, so a small difference between the photograph and the work in hand is normal and is not a fault.

10. Copyright

Buying a work transfers ownership of that physical object. It does not transfer copyright, which the artist retains. You may not reproduce, publish or make commercial use of an image of the work without written permission. You are of course free to display the work you own, and to photograph it for private purposes.

11. Governing law and disputes

These terms are governed by Swedish law. Nothing in them limits the mandatory consumer rights you have under the law of your country of residence.

If a dispute cannot be resolved with the studio directly, a consumer may refer it to the Swedish National Board for Consumer Disputes, Allmänna reklamationsnämnden (ARN), Box 174, 101 23 Stockholm. See arn.se. The studio undertakes to follow ARN's recommendation.

If you live in another EU country, the European Consumer Centre network can advise you on cross-border purchases.
